1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the website at minres.edu.au (the "Platform"), operated by MINRES Training Institute Pty Ltd ("MINRES", "we", "us", or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform. We reserve the right to update these Terms at any time; continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

2. Purpose of the Platform

MINRES.edu.au is an educational resource platform designed to support mining supervisors and industry professionals in Australia. It provides on-demand learning content including podcasts, quizzes, quick guides, short courses, and links to government regulatory resources.

The Platform is intended for educational and informational purposes only. Nothing on this Platform constitutes legal advice, regulatory guidance, or a substitute for professional legal or safety consultation.

3. Educational Content Disclaimer

All content on the Platform — including podcasts, quizzes, guides, and topic summaries — is provided for general educational purposes. While we take care to ensure accuracy, the content:

  • Does not constitute legal, safety, or regulatory advice
  • May not reflect the most current legislative amendments or regulatory interpretations
  • Should not be relied upon as the sole basis for compliance decisions
  • Does not replace your obligations to consult primary legislation, recognised standards, or qualified legal and safety professionals

You are responsible for verifying that any information you act upon is current, accurate, and applicable to your specific circumstances and jurisdiction.

4. CPD Points and Certificates

CPD (Continuing Professional Development) points and certificates issued through the Platform are provided as a record of your engagement with educational content. They are not accredited by any government body or professional association unless otherwise stated. You are responsible for verifying whether these records are accepted by your employer, professional body, or regulator.

5. Affiliate Links

The Platform's Shop page contains affiliate links to third-party retailers (including Amazon). If you purchase a product through an affiliate link, MINRES may receive a small commission at no additional cost to you. We only recommend products we believe are relevant and useful to our audience.

6. User Conduct

When using the Platform, you agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Submit false, misleading, or defamatory content through any form or contribution mechanism
  • Attempt to gain unauthorised access to any part of the Platform or its underlying systems
  • Use automated tools (bots, scrapers) to extract content from the Platform without our written consent
  • Reproduce, distribute, or commercially exploit Platform content without prior written permission
  • Impersonate any person or entity, including MINRES staff or contributors

7. Contributor Submissions

If you submit content to the Platform through the Contribute form (podcasts, quizzes, guides, or short courses), you:

  • Warrant that you own or have the right to submit the content, and that it does not infringe any third-party intellectual property rights
  • Grant MINRES a non-exclusive, royalty-free, perpetual licence to use, publish, and adapt the submitted content on the Platform
  • Acknowledge that submitted content is subject to editorial review and may be modified, rejected, or removed at MINRES's discretion
  • Understand that approved contributions will be attributed to you by name and credentials unless you request otherwise

8. Intellectual Property

All original content on the Platform — including text, graphics, logos, course materials, and software — is the property of MINRES Training Institute Pty Ltd or its licensors and is protected by Australian copyright law.

Government documents linked from the Resources page (Queensland and Western Australian Recognised Standards, Guidelines, and Guidance Notes) remain the property of the respective government agencies and are subject to their own copyright terms.

You may print or download content for personal, non-commercial use only. Any other reproduction or distribution requires our prior written consent.

9. Third-Party Links and Resources

The Platform contains links to third-party websites, including Queensland and Western Australian government resources, Amazon, LinkedIn, and YouTube. These links are provided for convenience only. MINRES does not endorse, control, or take responsibility for the content, accuracy, or practices of any third-party site.

10. Limitation of Liability

To the maximum extent permitted by law, MINRES excludes all liability for any loss or damage (including indirect, consequential, or economic loss) arising from your use of, or reliance on, the Platform or its content.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation that cannot lawfully be excluded or limited, including the Australian Consumer Law.
